1. Scope and object of the contract. 1.1. These General Contract Conditions govern the relationship between Short Rent 3000 (hereinafter "SR3000") and the Customer with regard to the provision of accommodation services chosen by the Customer in the booking proposal made among those offered by the Structure, which can be viewed on the website www.sr3000 .smoobu.net. 1.2. The request for provision of the Services can be made by the Customer by submitting the Booking Proposal to SR3000 by: sending an email to the email address stefano.bertoletti63@gmail.com or sr3000@host.smoobu.com; by telephone, orally, by contacting the number +39 3357744338; directly and immediately through the online booking procedure on the site. 1.3. The contract is considered concluded when the Customer formulates the booking proposal in the manner provided for in point 1.2. and brings it to the attention of SR3000. The actual conclusion is always subject to the availability of the Service. This confirmation is provided by SR3000 upon receipt of the Proposal or at a time immediately thereafter. 1.4. If the activation of the Services cannot take place due to impediments not attributable to SR3000, the contract will be terminated automatically, without this entailing any type of liability on the part of SR3000 towards the Customer.
2. Activation and provision of the Service. 2.1. Upon activation of the Service, SR3000 guarantees the Customer: – the enjoyment of furnished housing units (hereinafter "Apartment"), as defined in the proposal, clean and equipped with bed and bathroom linen; – the internet connection. 2.2. SR3000 will deliver to the Customer on loan for use any other accessory equipment aimed at the complete use of the chosen Services (keys, cards, etc.). 2.3. The Customer must use the apartment, common areas and equipment in such a way as not to disturb the normal performance of the Service and third parties residing/lodging in the same building in which the apartment is located. The Customer will be exclusively liable for any direct damages resulting from the violation of this obligation, holding SR3000 harmless from any consequences, costs or charges. 2.4. The Customer will hold SR3000 harmless from any prejudice, damage, liability, expenses, including legal expenses, suffered or incurred by SR3000, and will also indemnify it from any action, reason, claim advanced by third parties against it which find cause or reason in behavior and/or omissions in any case attributable to the Customer himself or are in any case a consequence of non-observance and/or violation of the precepts set out in these General Contract Conditions.
3. Booking and Payment. 3.1. In the case of direct and immediate booking, SR3000 requires the Customer to pay the amount due at the time of booking, by credit card. 3.2. In the case of booking via booking request made by sending an email to the email address stefano.bertoletti63@gmail.com or sr3000@host.smoobu.com, or by telephone, in verbal form, by contacting the number +39 3357744338, SR3000 will require the Customer to pay the amount due in the manner that will be agreed. Failure to pay the amount due within the above terms will result in the cancellation of the reservation, without the need for any communication from SR3000.
4. Duration of the Contract, cancellations and penalties. 4.1. The Contract is valid and effective from the date of conclusion of the Contract itself and ends if both of the following conditions are satisfied: – the Customer and third parties connected to him, or dependent on him, have definitively left the SR3000 housing facility; – the Customer has paid the entire amount due to SR3000. 4.2. Check-in must be carried out between 3.00 pm and 11.00 pm. Any arrivals outside of hours must be agreed in advance with SR3000. Check-out must strictly take place by 10:00 am. Any out-of-hours check-outs must be agreed in advance with SR3000. 4.3. the Customer has the right to cancel the booking and terminate the contract within the time limits set out in point 4.4 below. No refund is provided for the guest who leaves SR3000 early, whatever the cause. 4.4 Cancellations. In case of no-show or cancellation less than 7 days before arrival, the amount paid will not be refunded. In case of cancellation before 60 days from the arrival date, the amount paid will be refunded in full. In case of cancellation between 59 and 30 days from the arrival date, the amount paid will be refunded 60% of its amount. In case of cancellation between 29 and 7 days from the arrival date, the amount paid will be refunded 30% of its amount.
5. Protection of privacy. 5.1. The Customer is informed, pursuant to article 13 of Legislative Decree no. 196/2003, that the processing of personal data provided to SR3000 is necessary in order to allow SR3000 directly or through third parties to fulfill the obligations deriving from the this contract or for the fulfillment of obligations established by law or regulations. 5.2. The data controller is the legal representative of SR3000.
6. Documents. 6.1. Immediately following the booking, SR3000 will request via email the valid identity documents (Passport, Identity Card) necessary for the registrations required by current legislation. Failure to comply with this obligation constitutes a violation of the provisions of the Penal Code and will result in the booking not being completed. Our guests' data is processed in accordance with current privacy legislation.
7. SR3000 Responsibilities. 7.1. SR3000 will be responsible for breach of contract and provision of the Service exclusively for actions attributable to it. 7.2. If upon arrival the Customer notices a different Service from the one agreed upon but accepts it anyway, he/she is automatically considered forfeited from any claim for compensation and the new Service replaces, by agreement of the parties, the one previously agreed upon.
8. Limits of liability. 8.1. SR3000 will not be responsible in the event of delays, inconveniences, malfunctions and/or interruptions of the Service due to: – unforeseeable circumstances or force majeure; – tampering or interventions on the service or equipment carried out by the Customer or by third parties not authorized by SR3000; – damage or inconvenience caused by the total or partial interruption of the electricity or water supply; – SR3000 will not be responsible for valuables owned by customers and brought into the facility.
9. Management recommends: 9.1. Silence/Children. Total silence must be observed from 11.00 pm to 8.00 am and from 2.00 pm to 4.00 pm; Children must always be accompanied by an adult. In any case, behavior must be maintained which at no time of the day and in no way harms the tranquility of others. 9.2. Other Guests. It is strictly forbidden to introduce other people into the apartment without the authorization of SR3000, under penalty of a supplement of €250.00. The customer will not be able to sublease or loan the apartment, in whole or in part, under penalty of termination of the booking fee and a penalty supplement of €250.00. 9.3. Smoking/Weapons/Drugs. It is strictly forbidden to introduce weapons, drugs and other substances, under penalty of immediate termination of the contract. Smoking in the apartment is also strictly prohibited. You can freely smoke on the terrace, where available. 9.4. Personal objects. No objects of any kind may be left in the corridors or common areas. SR3000 is not responsible for personal items left unattended. N.B. we decline any responsibility for the loss, theft or damage to objects of your property left unattended in the apartment. 9.5. Animals. It is strictly forbidden to bring animals of any kind or size into the apartment. 9.6. Harassing behavior. The Customer is prohibited from carrying out acts and behaving in a manner which may cause nuisance to other inhabitants of the building. 9.7. Toilet. Correct and civil use of toilets is recommended, avoiding throwing anything into the toilet. (use the appropriate baskets).
